Welcome to the Preview Solution (the "Demo"), a demonstration environment provided by the trading as entity "Etoile Trade" ("we," "us," or "our"). By accessing or using the Demo, you ("you" or "User") agree to be bound by these Terms of Service ("ToS"). If you do not agree, do not access the Demo. These terms are designed to comply with laws in the United Kingdom, Australia, and other jurisdictions, subject to mandatory local laws.

1. Nature and Purpose of the Demo

The Preview Solution is a non-production, evaluation-only platform designed to showcase the functionality of our software for potential clients. All data, figures, content, and outputs displayed within the Demo are fictional, hardcoded, and provided solely for illustrative purposes. You acknowledge and agree that:

  • No data entered, generated, or displayed in the Demo is real, persistent, exportable, or representative of actual performance.
  • You have no ownership, intellectual property, or other rights to any content, data, or outputs within the Demo.
  • The Demo is provided "as-is" for evaluation purposes only, with no warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or accuracy.

2. Ownership and Intellectual Property

All content, code, designs, data, and other materials within the Demo are the exclusive property of [Your Company Name] and are protected by applicable copyright, trademark, and other intellectual property laws in the United Kingdom, Australia, and worldwide. You may not copy, reproduce, distribute, modify, reverse-engineer, or create derivative works from any part of the Demo without our prior written consent.

3. Permitted Use

You may use the Demo solely for evaluating the software's functionality as a potential client. Any other use, including but not limited to commercial use, redistribution, data scraping, or unauthorized access, is strictly prohibited. You agree to comply with all applicable laws, including the UK's Consumer Rights Act 2015 and Australia's Competition and Consumer Act 2010 (Australian Consumer Law).

4. No Warranties

The Demo is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, except for non-excludable guarantees under the Australian Consumer Law or UK consumer protection laws (e.g., Consumer Rights Act 2015). We do not warrant that the Demo will be uninterrupted, error-free, or suitable for your specific needs. You assume all risks associated with the use of or reliance on the Demo, including reliance on hardcoded figures or sample data.

5. Limitation of Liability

To the fullest extent permitted by applicable law, including the UK's Consumer Rights Act 2015 and Australia's Competition and Consumer Act 2010, [Your Company Name], its affiliates, officers, directors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or reliance on the Demo, including but not limited to losses from decisions based on demo data. In jurisdictions where liability limitations are restricted (e.g., for non-excludable consumer guarantees), our liability is limited to the minimum permitted by law, such as resupply of the service or refund of any fees paid (if applicable).

6. Governing Law and Dispute Resolution

These ToS are governed by the laws of England and Wales, without regard to its conflict of law principles, except where mandatory local laws apply (e.g., Australian Consumer Law, EU consumer protections). Any disputes arising from these ToS or your use of the Demo shall be resolved exclusively in the courts of England and Wales, unless prohibited by your local laws. 7. Compliance with Local Laws

To the extent that any provision of these ToS is unenforceable under mandatory laws in your jurisdiction (e.g., UK's Consumer Rights Act 2015, Australia's Competition and Consumer Act 2010), such laws will prevail only to the extent necessary, and the remaining provisions will remain in full effect.

8. Termination

We reserve the right to terminate or suspend your access to the Demo at our sole discretion, without notice, for any reason, including suspected violation of these ToS.
